Arrested7

On September 12th, 2022, the United States Attorneys’ Office for the Middle District of Florida announced felony child sex crimes charges against Miguel Diaz Gonzalez, a 40-year-old man from Orlando. Mr. Diaz Gonzalez stands accused of filming his sexual assault of an 8-year-old child. The allegations in this case are especially heinous. Here, our Orlando sex crimes defense lawyer provides an overview of the allegations and the federal charges filed in this case.

Federal Investigators: Child Sex Crime Uncovered in Orlando

According to allegations raised by federal investigators, Miguel Diaz Gonzalez of Orlando went by the moniker “Satans Child” on the internet. Law enforcement contends that a tip was provided to the National Center for Missing and Exploited Children (NCMEC). On the basis of that tip, a search warrant was obtained for the Orlando, FL home of Mr. Diaz Gonzalez.

Prosecutors indicate that a significant amount of relevant evidence was recovered on computer’s owned and controlled by Mr. Diaz Gonzalez. The computers were used to connect the man to the “Satans Child” internet account. Police believe that Mr. Diaz Gonzalez used the account. They believe he was the man in the video of rape of a young child. The child had previously been in the care of the defendant.

If convicted of the offense, Miguel Diaz Gonzalez of Orlando faces a minimum mandatory sentence of 15 years in federal prison. The sex crimes charge carries a maximum sentence of 30 years in federal prison. The DOL emphasizes that these are allegations. All defendants are presumed innocent until proven guilty in a court of law.

Federal Child Sex Crimes Charges

This is a federal child sex crime investigation. 40-year-old Miguel Diaz Gonzalez is facing charges under 18 U.S. Code § 2251. More specifically, the criminal complaint accuses him of the production of child sex abuse material. Under federal law, any person involved with the production or transport material involving the sexual exploitation of a child can be arrested and charged with a very serious federal felony criminal offense. The law strictly prohibits the:

  • Production;
  • Distribution;
  • Transportation;
  • Reception; and
  • Possession of child pornography.

Given the specific allegations raised in this case, the defendant could all face additional felony criminal charges. That being said, a violation of 18 U.S.C. § 2251, which bars the production of child pornography, carries a mandatory minimum 15 year federal prison sentence for a first-time offender. A conviction for this sex crimes offense  also requires lifetime registration on the sex offender’s list.
