Doctor Convicted For Unlawfully Distributing Opioids

Drugs9

A federal judge recently convicted Dr. Michael Fletcher, a former member of the Kentucky Board of Medical Licensure (KBML), for illegally distributing opioids. The Baez Law Firm is not involved in this matter but uses it as an example to highlight serious breaches in medical ethics and regulatory responsibilities, especially given Fletcher’s role in overseeing disciplinary actions against other physicians for similar misconduct.

Dr. Fletcher, a physician at Interventional Pain Specialists (IPS) in Crestview Hills, Kentucky, was found guilty of three counts of unlawful distribution of a controlled substance. Despite his position at the KBML, where he was responsible for monitoring and disciplining improper prescription practices, Fletcher was involved in the very activities he was meant to prevent.

According to court documents and trial evidence, Fletcher prescribed opioids to patients who had tested positive for illegal drugs like cocaine and heroin. This illegal activity was partly motivated by the opportunity to perform and bill for lucrative, often unnecessary, medical procedures on these patients. The trial revealed that seven patients under his care died from drug-related complications shortly after receiving opioid prescriptions from him.

Legal Implications and Sentencing

Dr. Fletcher is scheduled to be sentenced on December 17. Each count of unlawful distribution carries a maximum penalty of 20 years in prison. The actual sentence will be determined by a federal district court judge, who will consider the U.S. Sentencing Guidelines and other statutory factors.

Investigation and Prosecution

The investigation into Fletcher’s activities was conducted by a coalition of federal and state agencies, including the DEA, FBI, HHS-OIG, DOL-EBSA, and the Kentucky Medicaid Fraud Control Unit. The case was prosecuted by Trial Attorneys Dermot Lynch and Natalie Kanerva from the Criminal Division’s Fraud Section, which leads efforts to combat healthcare fraud through the Health Care Fraud Strike Force Program.

The Health Care Fraud Strike Force Program

The Health Care Fraud Strike Force Program, established in March 2007, plays a crucial role in addressing healthcare fraud. To date, it has charged more than 5,400 defendants who collectively billed federal health care programs and private insurers more than $27 billion. The program operates in 27 federal districts and collaborates with the Centers for Medicare & Medicaid Services and the HHS-OIG to hold providers accountable for healthcare fraud.

Unlawful Distribution of Controlled Substances

Unlawful distribution of controlled substances is a severe offense under federal law. It involves the prescribing or dispensing of drugs without a legitimate medical purpose and outside the usual course of professional practice. This illegal activity not only endangers patients but also undermines public trust in the medical profession.

The Role of Medical Licensing Boards

Medical licensing boards, such as the KBML, are responsible for ensuring that physicians adhere to professional standards and ethical practices. Members of these boards are expected to uphold the law and maintain the integrity of the medical profession. When a board member violates these principles, it raises significant concerns about the efficacy of regulatory oversight.

The Impact on Patients and Public Health

The illegal distribution of opioids by medical professionals has far-reaching consequences. Patients who receive unnecessary or inappropriate prescriptions are at risk of addiction, overdose, and death. Additionally, the proliferation of opioids contributes to the broader opioid crisis, which has devastating effects on communities across the United States.

In Dr. Fletcher’s case, his actions directly resulted in the deaths of multiple patients, highlighting the critical need for stringent oversight and accountability in the medical field.
